Environmental News - Fines for infringement of waste regulations


Two companies have recently been fined significant sums of money for infringments of waste regulations.

On 9th  October 2007 an Italian food importer and distributor was ordered to pay £62,250 at Camberwell Green Magistrates Court today for failing to recover and recycle up to 618 tonnes of packaging waste. Baselica Ltd, based in Upper Tulse Hill, London pleaded guilty to failing to register with the Environment Agency as a producer of packaging, and to failing to meet its requirements to recover and recycle packaging waste between 1998 and 2006. 

Under the Producer Responsibility Obligations (Packaging Waste) Regulations, all businesses with an annual turnover in excess of £2 million that handle more than 50 tonnes of packaging each year, must be registered with the Environment Agency or a compliance scheme. Each year, the company must also provide evidence of payment for the recovery and recycling of a specified proportion of packaging waste, including wood, aluminum, steel, cardboard and plastic.

On 8th November  2007, Derwent Fencing Limited of Hilton, Derbyshire, was fined £15,000 for keeping, treating and burning waste without a licence. The charge was brought by the Environment Agency under Section 33 of the Environmental Protection Act 1990. Derwent Fencing Limited was fined £15,000 and ordered to pay costs of £1,872.57.
